VACATION RENTAL AGREEMENT
THIS AGREEMENT IS NOT A LEASE AND CONVEYS NO RIGHTS IN REAL PROPERTY AT ANY TIME. YOUR USE IS LIMITED TO THAT DEFINED HEREIN.

• The number of people on the property may not exceed the number of guests in your reservation confirmation plus two (regardless of whether they are staying the night or just visiting). Additional guest fees starting at $65 per person per night will apply for any unauthorized persons.

• Your sole right to access the property begins with the 3PM check-in and ends at the 11AM check-out, unless other times are approved in writing in advance. Check-in is not allowed after 9PM unless approved in advance. We will charge 50% of the daily rate for an unauthorized early arrival or late check-out.

• Dogs are allowed with prior written permission, with the payment of an additional cleaning fee, and only at certain properties. Dog owners agree to the following additional rules: use protective sheets that we will leave out for you to cover any place where your dog may lie (we are not equipped to shampoo furniture or rugs or dry clean bedding after your departure); dogs must be leashed at all times when outside (there are coyotes in the High Desert, which present danger to unleashed dogs) and owners must immediately pick up after their dogs and deposit waste in a plastic bag and place it in the garbage bin; dogs are not to be left unattended in the property at any time. In addition to our additional dog cleaning fee, we will deduct the costs of extra cleaning or repairs necessitated by the presence of your dog. If you bring any animal to
a house that does not allow pets, you will be charged a $500 fee for deep cleaning and dander removal.

• Recreational vehicles, motorcycles and camping or other overnight accommodations outside the property are not allowed. Violations of this policy will result in termination of the reservation with no refund.

• We do not guarantee the speed or availability of internet service. Internet service may be provided by a satellite and/or wireless provider and may be subject to more fluctuations and outages than you may be used to. We do not provide refunds or discounts due to internet problems that are related to the provider or weather. No illegal or abusive use of the Internet is allowed.

• Cell service may not be available at the property due to the rural nature and geography of the area.

• The High Desert occasionally has power outages due to its rural nature. We are not responsible for any outages of Southern California Edison or any inconvenience such outage may cause. We will notify you of any planned outages and if requested will attempt to accommodate you elsewhere in the event of a planned outage lasting more than 4 hours. But we do not provide refunds or discounts for power outages that are unplanned.

• No photoshoots are allowed on the property without prior written approval and the payment of additional fees. Unauthorized use of the rental property’s name, address, or images, including its interior, exterior, and / or private property surroundings, for any commercial use including but not limited to selling, advertising, TV, film production, electronic, or other media, is not permitted and we will seek to have any unauthorized use removed.

• Special events such as weddings and parties are not permitted without written approval and the payment of additional fees.

• Guests who utilize a property’s hot tub, pools and/or plunge pool do so at their own risk and we are not liable for any personal injury or other damages associated with such use. Guests may not use glass or pottery glassware, plates, etc. in or anywhere near any such water amenity. If any glass or pottery ware is broken in or near a water amenity, you will be charged the full amount to drain and refill the amenity and for any lost revenue during such service. Guests may not leave minors unattended at any hot tub, pool or plunge pool. If a water amenity is left uncovered, you will be charged a minimum of $100 for additional cleaning/filling/heating.

No lifeguard is on duty; the primary guest on the reservation is responsible for the safe operation of the pool and for the safety of any persons using the pool; by utilizing any pool or spa all guests acknowledge and accept the risk of injury resulting from use of the pool, malfunction of pool equipment, tripping or falling around the pool/spa and any other injuries that may occur and waive all claims against the homeowner or its representatives including Homestead Modern LLC.

• Guests shall allow the property owner or any designated workers access to the property for landscaping and routine maintenance, cleaning, repairs and building inspections, and pool and hot tub repairs and service.

• If for any reason beyond the control of the owner, the property is unavailable, we may cancel your reservation and refund the actual fees and / or deposits you have paid.

• Smoking is not allowed inside the property or within 15 feet of any exterior door. Please dispose of your extinguished cigarette waste in a plastic bag and then into the outdoor garbage can. Do not leave cigarette waste on the grounds. If these rules are violated, we will charge a minimum of $250 for remediation.

• Propane firepits or fireplaces may not be used for burning wood or any other materials (it is illegal pursuant to a county ordinance and may damage the fixture). If any combustible materials are burned in them, we will charge a minimum of $500 cleaning fee.

• By making your reservation, you confirm that you will comply with (and your stay is allowed by) any applicable health or safety orders from the State of California.

• Firearms are not allowed on the property.

• Local ordinances prohibit any loud, excessive, or intrusive noise that disturbs the peace or that causes discomfort or annoyance to any reasonable person at any time as well as strict quiet hours between 10PM and 7AM.

• Please pay attention to all relevant short-term rental ordinances and other regulations (such as the noise ordinance above) in accordance with county or town guidelines. If you violate any ordinance and as a result the property is fined, you will be responsible for payment of the fine plus a $500 administrative fee.

• Payments are due 50% at 60 days before check-in and 50% at 30 days before check-in (or at the time of reservation if less than the days for either payment). For bookings made directly on our website, no cancellation is allowed less than 5 days before check-in (100% of the charges and booking fees are non-refundable at that time).

• A deposit is required at the time of booking and any unused portion will be returned 7 days after checkout. Bookings made directly on our website or through Vrbo are charged an accidental damage protection fee – with payment of this non-refundable fee, you will not be held responsible to pay for accidental damage or loss to the rental property resulting from you or others in your party up to $1000 and that you report to us during your stay. This plan does not cover intentional acts of a guest, gross negligence, or willful and wanton conduct, and/or damages caused by pets.

• We may withhold all or part of your deposit if you fail to follow the rules in this agreement, the property listing or the property house manual. If the cost of the damages, losses, or missing items exceed the amount of the deposit, we will bill your credit card for the difference and / or pursue legal action. Cause(s) for withholding deposit funds include, but are not limited to: damage to premises or contents, missing or broken items, lost keys, required excessive cleaning, not complying fully with the departure checklist, smoke odors or damage, mailing charges for items left behind, unauthorized persons visiting or staying on the property, the presence of a dog without authorization, noise complaints after 10PM, including fines, trespassing on neighboring properties, violation of any county or town rules and unauthorized late check-out.

This was an excellent place to stay, relax and just enjoy the views. The space is even better than the pictures. One of the things we appreciated the most was all the natural light that the large windows provided. The place was very tidy and had a well stocked kitchen for us to make our dinner and feel like we were right at home. The hot tub was our favorite part and was perfect to enjoy the dark night sky. We hope to be back and further relax.

This home is lovely. The host was always approachable. Responded almost immediately as I lead up to my stay super friendly and professional and kind. Had a minor situation with the meat and I let them know, and that was taken care of within an hour and a new delivery came and the house is spotless. I love the big windows it’s pretty much soundproof it’s just so beautiful and serene and peaceful kitchen is perfect bedrooms were perfect. The bathrooms I will say the Jacuzzi and the cowboy tub is a must every night you just sit there and watch the stars in the shooting stars I was very impressed. I fell in love with the pictures and I was so excited I was months ahead texting like I’m so excited to the hoes, the host was answering me back, everything was easy from check in and how they make sure you get the keys and they have somebody come to service the Jacuzzi twice a week. Trash is accessible not too close to the house but close enough if that makes sense.

Terra was great with plenty of open space around the house. It’s located slightly lower on a gradual hill than three other houses hosted by Homestead Modern, so the hottub and outdoor showers aren’t completely private but this one of the four also affords the best/least obstructed views to the east towards 29 Palms. The home is on a dirt road which could have ruts/bumps but was still easy to travel, and the apple maps directions to the address provided matched the directions the host sent. The house is accessed with a key gotten from a lockbox with a code, which worked well for a checkin at 9pm. The hosts sent us all the information we needed, and luckily we did not need to ask them for any more help. This place is a great choice!

Our stay at Terra Joshua Tree was amazing! It was our first time to experience the area and we were not disappointed! The home is flooded with natural light and the views from every room are breathtaking! It is tastefully decorated with mid century modern decor. The bed and linen are super comfortable! The kitchen is nicely equipped, but we dined on the great local restaurant food. Our favorite thing about the house is the Jacuzzi hot tub! We did our star gazing while relaxing in the warm water! We will be back for sure!

I think it would have been nice if we were offered an extra hour to check out. Doing dishes by hand for 3 days was a little more than I bargained for my birthday trip ...but I would stay again if everything was in working order.

It's a great house and great location. Very modern and private. The host only provides one bath towel per guest, so if you need more towels, bring your own. Also, we wish we had known that the fire pit was not working prior to booking. Overall, it was a good experience.

This was a perfect place to use as a base to explore Joshua Tree National Park, spend time with family, enjoy the sunsets and sunrises via the floor-to-ceiling windows, and see roadrunners and jackrabbits on the property. This was the perfect place to stay for our first time visiting Joshua Tree National Park. Ideal and convenient location off of the main highway with minimal background noise. Beautiful views from all windows and surrounding the property. Well stocked kitchen made making most of our meals at home very doable. We had the best stay over Thanksgiving with Homestead Modern! The house is in a great location (6 mins to town, 15-20 mins to park entrance), very clean, stocked with everything you need, and a lot bigger than it seems in the photos. Everyone we encountered (cleaning crew, maintenance, and HM staff) were all so nice and very accommodating. We loved the little touches they left and pie they brought over for Thanksgiving was so thoughtful. The property even had an outlet by the parking spot so we were able to charge our car and avoid going to the supercharger at the casino in Twentynine Palms. Couldn't recommend this house enough and we will definitely stay at one of their properties again!

While searching for a place to visit for our 25th wedding anniversary, we came across Homestead Modern’s Terra home in Joshua Tree, CA. It was absolutely PERFECT! Spaced far enough away from other properties, we enjoyed our privacy up on the land. Loved the cool water in the cowboy tub, hot tub relaxation at night, and nice, fresh outdoor showers in the morning!?? The interior decor was stunning, precious modern pink touches with natural elements throughout the space. Big, view-gazing windows—just so calm and peaceful. Super comfortable bed, well-stocked kitchen, adorable hammock to relax and read in, abundant outdoor seating, this home really has it all! We loved visiting Palm Springs (Frank Sinatra house and Felipe’s Mexican restaurant), Pioneer Town (a very lovely-scented boutique shop XeBA BOTaNICA, which we didn’t expect to find there! Candles, balms, sage, beautiful wall-hangings and sculptures). Joshua Tree National Park was breathtaking, we turned up U2 and cruised through the park all three days that we stayed. Wonderful cafes: Joshua Tree Coffee, The Country Kitchen, Joshua Tree Saloon, C & S Coffee Shop, and Crossroads Cafe to name a few. Staying at Terra and being in Joshua Tree was one of our favorite journeys of all-time!! We can’t wait to definitely return, and bring along our grown kiddos to share in the experience!? Check-in was fairly easy. There was a problem with our code, but the property management company took care of it right away. They also let us add on an additional night at the last minute to allow us to check-in first thing in the morning (we wanted to get there early to beat traffic and start working with desert views!) The outlet near the parking space kept tripping when we tried to charge our car, we had to charge in 29 Palms instead at the supercharger. Overall the stay was very relaxing and we enjoyed our time. The views were amazing and we liked using the cowboy tub.

Great views, comfy place to sleep. There’s NO blocking out the sun, so bring a sleep mask if the dim glow coming from behind the excellent blackout shades will bother you. The dirt road in is rugged enough to feel like an adventure, but tame enough to be handled by the rental Corolla. If you're considering a spot in the Joshua Tree desert, this is the place! Pictures don't always do places justice. The ceilings and doors are soaring high, modern finishes, fully equipped bathroom and kitchen supplies, multiple walk-out patios, on-point design/decor, and views for days. Be sure to check out Joshua Tree National Park (a short drive) even if just for the brief "nature trail". Groceries, gas, household items, shopping, etc. are readily available, also just a few-minute drive. I hope you have a chance to enjoy it as much as I did. Elementum Terra is all about the views and easy access to hiking. The location is stunning, and the hot tub right next to a gorgeous, sculptural joshua tree is the cherry on top. My bf and I (and our two pups) were REALLY looking forward to our getaway. The house was perfect for what we were looking for, and it had the most important thing - a hot tub! The communication with the host was quick and helpful! We weren’t going to do any crazy hikes, or checking out the town..it was a place for us to fully relax and enjoy ourselves - and we were able to here! The entire house is amazing. The water gets hot fast, the heater and AC work wonderfully, the natural lighting in the house is spectacular, and the views!! Let’s not forget..wifi connection speed was great. You can see the other neighbors from your house, and If you’re on the taller side, they could definitely see you showering outside, but nothing a bikini top can’t fix! Our dogs loved hanging out here - and just be careful because there are a lot of cholla cacti surrounding the house, and a few spikes were on our dogs. The hot tub was GREAT!! The temperature was perfect on a chilly night, and it was amazing to hang out under the stars. We would 100000% stay here again and again! I wish I could just live there LOL. The jacuzzi was amazing! We got to enjoy stargazing at our most comfortable state. Kitchen was very well equipped, many baking equipments. What a dream home to stay in! Literally the most beautiful sunrise i had experienced in a long time. Booked it for a solo birthday trip with myself and my pup and it was truly the best. Even made friends with the neighboring house. Felt safe although the wind freaked out my pup! To note, there’s a v extremely questionable painting in the house posting/advert but know that it’s no longer there ??. Oh and the biggest plus. The wifi was INCREDIBLE. This was an excellent place to stay, relax and just enjoy the views. The space is even better than the pictures. One of the things we appreciated the most was all the natural light that the large windows provided. The place was very tidy and had a well stocked kitchen for us to make our dinner and feel like we were right at home. The hot tub was our favorite part and was perfect to enjoy the dark night sky. This home is lovely. The host was always approachable. Responded almost immediately as I lead up to my stay super friendly and professional and kind. Had a minor situation with the meat and I let them know, and that was taken care of within an hour and a new delivery came and the house is spotless. I love the big windows it’s pretty much soundproof it’s just so beautiful and serene and peaceful kitchen is perfect bedrooms were perfect. The bathrooms I will say the Jacuzzi and the cowboy tub is a must every night you just sit there and watch the stars in the shooting stars I was very impressed. I fell in love with the pictures and I was so excited I was months ahead texting like I’m so excited to the hoes, the host was answering me back, everything was easy from check in and how they make sure you get the keys and they have somebody come to service the Jacuzzi twice a week. Trash is accessible not too close to the house but close enough if that makes sense.

Terra was great with plenty of open space around the house. It’s located slightly lower on a gradual hill than three other houses hosted by Homestead Modern, so the hottub and outdoor showers aren’t completely private but this one of the four also affords the best/least obstructed views to the east towards 29 Palms. The home is on a dirt road which could have ruts/bumps but was still easy to travel, and the apple maps directions to the address provided matched the directions the host sent. The house is accessed with a key gotten from a lockbox with a code, which worked well for a checkin at 9pm. The hosts sent us all the information we needed, and luckily we did not need to ask them for any more help. This place is a great choice!

Beautiful property and location was central close to shops and Joshua tree park. Easy check in / and check out process. Host was responsive and attentive. Only concern was the cleanliness as there were used towels on the bathroom floors and the toilet wasn't flushed. Otherwise, it was a great.

Our stay at Terra Joshua Tree was amazing! It was our first time to experience the area and we were not disappointed! The home is flooded with natural light and the views from every room are breathtaking! It is tastefully decorated with mid century modern decor. The bed and linen are super comfortable! The kitchen is nicely equipped, but we dined on the great local restaurant food. Our favorite thing about the house is the Jacuzzi hot tub! We did our star gazing while relaxing in the warm water! We will be back for sure!

I think it would have been nice if we were offered an extra hour to check out. It's a great house and great location. Very modern and private. The host only provides one bath towel per guest, so if you need more towels, bring your own. Also, we wish we had known that the fire pit was not working prior to booking. Overall, it was a good experience.

We loved our stay at Terra Joshua Tree. The beds were wonderful, the hammock in the room was a cool touch, the bathrooms were modern and well designed. The kitchen was well appointed and even had a cupcake pan and hand mixer! We loved the hot tub! The host was very responsive when we had an issue with the grill. This was a perfect place to use as a base to explore Joshua Tree National Park, spend time with family, enjoy the sunsets and sunrises via the floor-to-ceiling windows, and see roadrunners and jackrabbits on the property. The home's floor plan was perfect for sharing spaces due to the individual bedroom/bathroom combos. Loved the showers and comfy beds. If you like to cook, this is the place for you - excellent kitchen with sharp knives and a good stove plus all other essentials. The furnishings were moderate, eclectic and also practical. The heat worked great. It was a perfectly quiet place to vacation. And the hosts were so communicative. We will come again.

This was the perfect place to stay for our first time visiting Joshua Tree National Park. Ideal and convenient location off of the main highway with minimal background noise. Beautiful views from all windows and surrounding the property. Well stocked kitchen made making most of our meals at home very doable. We loved using the outdoor gas fireplace and hot tub to stay warm while viewing the incredible night sky. Easy check in/out, communicative and informative messages left us feeling at home and without concerns our entire trip. We had the best stay over Thanksgiving with Homestead Modern! The house is in a great location (6 mins to town, 15-20 mins to park entrance), very clean, stocked with everything you need, and a lot bigger than it seems in the photos. Everyone we encountered (cleaning crew, maintenance, and HM staff) were all so nice and very accommodating. We loved the little touches they left and pie they brought over for Thanksgiving was so thoughtful. The property even had an outlet by the parking spot so we were able to charge our car and avoid going to the supercharger at the casino in Twentynine Palms. Couldn't recommend this house enough and we will definitely stay at one of their properties again!

While searching for a place to visit for our 25th wedding anniversary, we came across Homestead Modern’s Terra home in Joshua Tree, CA. It was absolutely PERFECT! Spaced far enough away from other properties, we enjoyed our privacy up on the land. Loved the cool water in the cowboy tub, hot tub relaxation at night, and nice, fresh outdoor showers in the morning!?? The interior decor was stunning, precious modern pink touches with natural elements throughout the space. Big, view-gazing windows—just so calm and peaceful. Super comfortable bed, well-stocked kitchen, adorable hammock to relax and read in, abundant outdoor seating, this home really has it all! We loved visiting Palm Springs (Frank Sinatra house and Felipe’s Mexican restaurant), Pioneer Town (a very lovely-scented boutique shop XeBA BOTaNICA, which we didn’t expect to find there! Candles, balms, sage, beautiful wall-hangings and sculptures). Joshua Tree National Park was breathtaking, we turned up U2 and cruised through the park all three days that we stayed. Wonderful cafes: Joshua Tree Coffee, The Country Kitchen, Joshua Tree Saloon, C & S Coffee Shop, and Crossroads Cafe to name a few. Staying at Terra and being in Joshua Tree was one of our favorite journeys of all-time!! We can’t wait to definitely return, and bring along our grown kiddos to share in the experience!? Check-in was fairly easy. There was a problem with our code, but the property management company took care of it right away. They also let us add on an additional night at the last minute to allow us to check-in first thing in the morning (we wanted to get there early to beat traffic and start working with desert views!) The outlet near the parking space kept tripping when we tried to charge our car, we had to charge in 29 Palms instead at the supercharger. Overall the stay was very relaxing and we enjoyed our time. The views were amazing and we liked using the cowboy tub.

Great views, comfy place to sleep. There’s NO blocking out the sun, so bring a sleep mask if the dim glow coming from behind the excellent blackout shades will bother you. The dirt road in is rugged enough to feel like an adventure, but tame enough to be handled by the rental Corolla. The surrounding towns have all the expected quaint shopping, arts, outdoor excursions one might expect. Definitely worth a weekend with a partner, especially one who won’t go camping.

If you're considering a spot in the Joshua Tree desert, this is the place! Pictures don't always do places justice. The ceilings and doors are soaring high, modern finishes, fully equipped bathroom and kitchen supplies, multiple walk-out patios, on-point design/decor, and views for days. Be sure to check out Joshua Tree National Park (a short drive) even if just for the brief "nature trail". Groceries, gas, household items, shopping, etc. are readily available, also just a few-minute drive. I hope you have a chance to enjoy it as much as I did. Don't miss the sunrise, sunset, and those nighttime stars!

Elementum Terra is all about the views and easy access to hiking. The location is stunning, and the hot tub right next to a gorgeous, sculptural joshua tree is the cherry on top. Also, I found the beds to be perfectly firm and supportive while offering a pleasantly soft place to rest. My bf and I (and our two pups) were REALLY looking forward to our getaway. The house was perfect for what we were looking for, and it had the most important thing - a hot tub! The communication with the host was quick and helpful! We weren’t going to do any crazy hikes, or checking out the town..it was a place for us to fully relax and enjoy ourselves - and we were able to here! The entire house is amazing. The water gets hot fast, the heater and AC work wonderfully, the natural lighting in the house is spectacular, and the views!! Let’s not forget..wifi connection speed was great. You can see the other neighbors from your house, and If you’re on the taller side, they could definitely see you showering outside, but nothing a bikini top can’t fix! Our dogs loved hanging out here - and just be careful because there are a lot of cholla cacti surrounding the house, and a few spikes were on our dogs. The hot tub was GREAT!! The temperature was perfect on a chilly night, and it was amazing to hang out under the stars. We would 100000% stay here again and again! I wish I could just live there LOL. The jacuzzi was amazing! We got to enjoy stargazing at our most comfortable state. Kitchen was very well equipped, many baking equipments. We had to work from home for a little while and wifi speed did not cause any inconvenience at all. From the moment we arrived we were so happy here - this was the best Airbnb we’ve stayed in. The house, in fact, exceeded our expectations and provided the perfect place for our visit to Joshua Tree and Palm Springs. What a dream home to stay in! Literally the most beautiful sunrise i had experienced in a long time. Booked it for a solo birthday trip with myself and my pup and it was truly the best. Even made friends with the neighboring house. Felt safe although the wind freaked out my pup! To note, there’s a v extremely questionable painting in the house posting/advert but know that it’s no longer there ??. Oh and the biggest plus. The wifi was INCREDIBLE. Stay solidly connected the whole time. Was able to get work done and steam music without interruption. And FaceTime was no big deal, even when walking around the area. The house was a dream house and will definitely book there again.

Very stylish and beautiful home! The view to the north and the east are particularly spectacular and there is a great indoor/outdoor feel. The strength of the A/C was much appreciated. Our stay here was absolutely amazing, no complaints! Actually, the place looks EVEN BETTER than in the photos, which are pretty great. Everything was sparkling clean and brand new. Wall-to-wall windows in the main room & high ceilings are stunning with the mid-century modern decor. The light is beautiful in the morning, and the view is so relaxing - open space for miles. Our kids enjoyed running around outdoors and sitting in the hot tub, checking out the stars at night. The property is very quiet and the bedrooms have blackout shades and super comfy beds.
